Full Terms and Conditions
As used in this Agreement, "We," "Us" or "Our" refers to Smartpay.uk trading as PJ Marketing & Management Ltd, and "You" or "Your" refers to the user. "Centre" means the Location of your classes and could include those classes sessions seminars clinics workshops posted on the World Wide Web.
Period of Agreement
• This agreement will continue, as a minimum, until all the payments detailed on the front of this form have been satisfied or until cancellation has been given via email or in writing to Smartpay.uk and the notice period as detailed in the cancellation terms section of the form have been met.
• This agreement is a commitment to retain a membership for the number of months stated on your emailed agreement, regardless of changes in personal circumstances, unless cancellation terms state otherwise.
• Should you continue to pay us by "Furture Pay" after the number of payments, as stated on the front have been made, the agreement will become a month-by month rolling agreement for which a 1 month cancellation notice period by email or in writing to Smartpay.uk is required.
• Where the agreement does not have a fixed number of payments but has been set to “Until Further Notice”, payers are required, as a minimum, to satisfy the cancellation terms after which, the payer is free to cancel their standing order. If no cancellation terms have been added- our Standard Cancellation Terms** apply
Breaching your Agreement
• If you cancel your standing order during the Minimum Term Period*, all unpaid monthly instalments that are due or to fall due during the Minimum Term Period* shall become immediately due and payable by you.
• If you fail to notify Smartpay.uk of your intention to cancel and stop your payments, your account will fall into arrears and administration charges, as detailed in the payment section below, will apply. Until such time that you notify us of your intention to cancel, your notice period payments plus any arrears accruing on the account will become due.
• Default Letters may be issued by post should you not respond to texts or emails. A further £10 charge will be added to the account for each letter sent.
Payment
• You must pay the monthly payments to us on the dates stated in Your agreement.
• If you fail to pay the whole or any part of the monthly payment on time, settlement via BACS or credit/debit card will be required. This will incur an administration fee of £10 if settled within the calendar month.
• Should the account remain in arrears at the start of the following month a further £20 administration fee will become due. A further £20 fee will be added to each subsequent thereafter for accounts that remain in arrears.
• We may refer any missed payments to a debt collection agency.
Pricing

The centre reserves the right to increase prices of the membership at any point during the term of the membership. We will give you at least 30 days’ notice of any price changes.

Whenever an increase is made to a standard price, you are entitled to terminate the remainder of the membership by providing one month’s notice to us, within fourteen days of receiving notice of the increase.
Information about You
• You must notify us, preferably by email, or alternatively in writing of any change in your home address or other information given by you in connection with this agreement.
• We may record or monitor telephone conversations with you for training and/or research purposes.
• Information held by us will not be shared with any third party other than the centre named and your bank /building society.
• Your personal information will not be used for any marketing purposes. We will only hold your information for as long as necessary.
• You can request a copy of any of the data held by us. You have the right to rectification; the right to erasure.
• We are compliant with the Data Protection Act and General Data Protection Regulation.
• We are registered with the Information Commissioners Office where you can view your rights at www.ico.org.uk
Temporary Illness or Pregnancy
• In the event of illness, injury or pregnancy we can arrange for your account to be put on hold providing we receive notice by email or in writing together with a note from your doctor.

• In the event of permanent injury or permanent illness, this agreement and the obligations under it, will be cancelled on production of a medical certificate issued by a doctor.
• In the event of death this agreement will be cancelled and the deceased estate will not incur a liability under this agreement.
• This agreement is cancellable either in accordance with the cancellation terms detailed on the front of the form or,
• For agreements that do not have a fixed number of payments but have been set to “Until Further Notice”, unless otherwise stated, our Standard Cancellation Period* rules apply.
• It is the responsibility of the payer to cancel their standing order once the notice period as detailed on the front of the form has been served.
• Note that no refunds will be given where payments have been made and the student has not attended.

* Minimum Term Period is the shorter of the total number of payments due as detailed in the email agreement and the cancellation notice period. If the agreement does not have a total number of payments or any cancellation terms detailed, this will be the Standard Cancellation Period**
** Standard Cancellation Terms is a minimum of three months payments with a one month notice by email or in writing to smartpay.uk thereafter. This applies ONLY to agreements with no fixed number of payments.
